TERMS & CONDITIONS

1. Introduction

These Terms & Conditions (“Terms”) govern all services provided by ARKI Solutions (“we”, “our”, “us”) to the client (“you”, “your”).
By purchasing or engaging with our services, you agree to be bound by these Terms.

2. Services Provided

ARKI Solutions offers website design, development, and management services for UK-based businesses, including:

  • Website creation and redesign
  • Custom domain setup
  • Hosting setup and management
  • Basic SEO optimisation
  • Website management and content updates
  • Technical support and maintenance

All services are delivered as outlined in your agreed proposal, quote, or order confirmation.

3. Project Process

3.1. Consultation:
Each project begins with a discovery and planning phase to confirm your requirements, goals, and design direction.

3.2. Design & Development:
We will design and develop your website based on the agreed scope, using best practices in web design, SEO, and performance.

3.3. Feedback & Approval:
You will have the opportunity to review and request reasonable revisions before final approval and project completion.

3.4. Completion:
Once the website is approved and full payment has been received, the project will be considered complete, and final access or transfer of ownership will occur.

4. Payments & Deposits

4.1. A 50% deposit is required before any work begins.
4.2. The remaining 50% balance is due upon completion of the project, before the website goes live.
4.3. Payment can be made via bank transfer, credit/debit card, or any method agreed upon in writing.
4.4. Deposits are non-refundable once work has commenced, as they cover initial planning, design, and development time.
4.5. ARKI Solutions reserves the right to withhold completed work, files, or website access until final payment is received in full.

5. Client Responsibilities

You agree to:

  • Provide all required content (text, images, logos, etc.) in a timely manner.
  • Respond to communications and approvals within reasonable timeframes to prevent project delays.
  • Ensure all provided materials are owned by you or licensed for use.
  • Obtain any required third-party permissions (e.g., images, fonts, plugins).

Failure to provide content or approvals may result in project delays or additional costs.

6. Timeframes

We will make every effort to meet agreed deadlines, but delivery times are estimates only.
Delays caused by late client responses, content delivery, or change requests may extend project completion.

7. Revisions & Additional Work

7.1. Reasonable design revisions are included within the agreed scope.
7.2. Additional requests, new functionality, or scope changes not originally quoted will be billed separately at our current hourly rate or as a new project quote.

8. Hosting, Domains & Management

8.1. Clients who select a Management Plan will receive ongoing website maintenance, hosting management, domain renewals, and monthly content tweaks as described.
8.2. Clients on a Standard Plan are responsible for their own hosting, renewals, and maintenance after completion.
8.3. We are not liable for downtime, security breaches, or issues arising from third-party hosting or plugins unless covered under a management agreement.

9. Intellectual Property

9.1. All intellectual property rights in design concepts, code, and graphics remain the property of ARKI Solutions until final payment is received.
9.2. Upon full payment, ownership of the completed website design and files will transfer to the client, excluding any third-party assets or licensed components.
9.3. We reserve the right to display completed work in our portfolio or marketing materials.

10. Cancellation & Termination

10.1. If you choose to cancel a project after work has started, the deposit is non-refundable.
10.2. If the project is cancelled after completion, the full balance remains payable.
10.3. We reserve the right to terminate a project for non-payment, lack of communication (14 days of inactivity), or breach of these Terms.

11. Limitation of Liability

11.1. While every effort is made to ensure accuracy and uptime, ARKI Solutions is not liable for:

  • Loss of business, revenue, or data resulting from website issues.
  • Downtime caused by hosting providers, third-party services, or software updates.
  • Content provided by the client.
    11.2. Our liability shall not exceed the total amount paid for the specific project.

12. Data Protection & Privacy

We process all personal data in accordance with the UK GDPR and our Privacy Policy.
We will only use your information to deliver our services, manage communication, and meet legal obligations.

13. Support & Aftercare

For clients on the Management Plan, ARKI Solutions provides continuous maintenance, small updates, and technical support as detailed in your package.
For Standard projects, post-launch support is available on a quoted, hourly, or per-request basis.

14. Governing Law

These Terms are governed by the laws of England and Wales.
Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
